Summary of today’s Essential Eight:
Xi skips BRICS Business Forum - Xi arrived in South Africa. He looked OK upon arrival and descending the stairs at the airport and in his meetings with Ramaphosa, but he skipped the BRICS Business Forum he was supposed to attend, sending Commerce Minister Wang Wentao in his place to read his speech. We have no idea why Xi changed his plans. I wrote in the Monday newsletter that “official media have reported on Xi’s activities and utterances since the end of the Beidaihe break, but so far there have been no videos or photos of him since early August, which seems a bit strange”, and this last minute decision to skip the business forum looks even stranger. So in the absence of any useful information from the PRC system rumors will fly, and we are left with examine the videos to see if he looks sick. Back to the future, sadly.

Japan to start releasing Fukushima waste water - Prime Minister Kishida has said that discharge of the waste water from the Fukushima nuclear power plant will begin Thursday. The levels of radiation in the water are far below the levels of radiation in water the PRC regularly releases into the ocean from some of its nuclear power plants, but that has not stopped PRC officials from pursuing a campaign to block Japan’s release. That campaign has failed, so now we wait to see how much economic pain the PRC will inflict through bans on imports of Japanese products.
Philippines resupplies grounded ship - The Philippines was able to resupply its marines stationed on the rusting, intentionally grounded ship Sierra Madre at Second Thomas Shoal. Last time they tried their boat was attacked with a water canon from a China Coast Guard (CCG) vessel. This time the PRC let the resupply happen, so long as they did not deliver any construction materials to shore up the rusting ship, as the PRC plan appears to be to prevent any maintenance, wait for the ship to break apart and then take what they call Ren'ai Reef. The CCG issued a statement that “China Coast Guard (CCG) on Tuesday restricted Philippine vessels trespassing into waters near China's Ren'ai Jiao (also Ren'ai Reef) in the South China Sea but under humanitarian consideration, temporarily allowed the transport of food to the Philippines' "grounded" warship”. The true test will come if/when the Philippines tries to deliver construction materials to the vessel.
Downturn means PRC even less likely to overtake US economic power? - So testified Rhodium Group’s Logan Wright to a US Congressional Commission, saying that “Beijing is no longer an economic pacing threat or likely to overtake the United States in any significant measure of economic power in the next two decades”. Raimondo to Beijing as US announces Tibet-related visa restrictions Commerce Secretary Raimondo will travel to the PRC on August 27. Continuing the trend of mixed messaging, on Monday the US removed 27 PRC entities from its export-control "unverified list" and on Tuesday announced new visa restrictions on unnamed PRC officials related to “the forcible assimilation of more than one million Tibetan children in government-run boarding schools”.

1. Xi skips BRICS Business Forum
In his place, Commerce Minister Wang Wentao read the speech that criticised the US over its tendency toward “hegemony”.
Xi, in the speech read by Wang at the Sandton Convention Centre in Johannesburg, said the US tended to fight countries that threaten its dominance in global affairs and financial markets.
The speech said that every country has a right to development and that people should have the freedom to pursue a happy life. But one country, he said in a thinly veiled swipe at the US, is “obsessed with maintaining hegemony, has gone out of its way to cripple the emerging markets and developing countries”.
“Whoever develops first becomes their target of containment. Whoever is catching up becomes its target of obstruction,” Xi added.

Xi made the remarks during his meeting with his South African counterpart, Cyril Ramaphosa, here in the country's administrative capital.
Ahead of his arrival, Xi said in his signed article published in South African media that the blossoming China-South Africa relationship "has entered a 'golden era,' enjoying broad prospects and a promising future."
While meeting with Ramaphosa, the Chinese leader called on both sides to be strategic partners of high-level mutual trust, adding that "camaraderie and brotherhood" are the true quality of bilateral ties.

African countries want China to shift its focus from building infrastructure on the continent to local industrialisation, China's top Africa diplomat said on Tuesday at a briefing on the sidelines of the BRICS summit in South Africa.
"African integration is already escalating and many African countries (have) asked China to consider (a) shift (of) our focus," Wu Peng, director-general of China's department of African affairs at its foreign ministry, said.

The key to China’s blueprint is to steadily institutionalise its leadership over the developing world by creating, expanding and funding a raft of China-led groupings of countries, according to Chinese officials and commentators. They add that the aims of this strategy are largely two-fold: to ensure that a broad swath of the world remains open to Chinese trade and investment and to use the voting power of developing countries at the UN and in other forums to project Chinese power and values.
The crucial context to this strategy is that by seeking increased leadership over the global south, China is throwing in its lot with the largest and fastest-growing part of the world. The 152 countries classified as developing at the UN vastly outstrip their developed counterparts on yardsticks such as population size and population growth, GDP growth rates over the past two decades and overall contribution to global GDP growth as measured by purchasing power parity...
Another key Chinese strategy is to present itself as a global peacemaker, partly to counter the reputational damage it suffered when its strategic partner, Russia, invaded Ukraine last year. Crucial to this ambition is the Global Security Initiative (GSI), which was proposed last year by Xi and is designed as a China-led multilateral forum.Its aim is to wrest influence away from the US on global security issues while elevating its own role, officials say. Part of the strategy to achieve this is to call for a “bigger UN role in security affairs” while expanding Beijing’s own role within the UN peacekeeping hierarchy.
This focus on the UN echoes that of the GDI and highlights a crucial feature of Xi’s three initiatives: rather than seeking to create a whole new world order, Beijing’s aim is to repurpose the UN’s authority to more squarely serve China.

Japan’s Prime Minister Fumio Kishida on Tuesday confirmed the process will start on Aug. 24 after a meeting of a cabinet panel. “If there are no issues with the weather and sea conditions, we expect the discharge to begin,” Kishida said. “The Japanese government will take responsibility to make sure the proposal is carried out safely, even if it takes decades until all of the treated water is discharged.”

Hong Kong Chief Executive John Lee said the release was "irresponsible" and posed "impossible risks to food safety and the irreparable pollution and destruction of the marine environment".
Lee, in a post on his Facebook account, said he had told Environment Secretary Tse Chin-wan and relevant departments to immediately activate import controls to protect food safety and public health.
"There is no timetable at this point about how long the ban will last," Tse told a press conference, adding that a decision would depend on data and information from the Japan after the discharge.
In July, Hong Kong said the ban would cover imported aquatic products from the Japanese regions of Tokyo, Fukushima, Chiba, Tochigi, Ibaraki, Gunma, Miyagi, Niigata, Nagano and Saitama.

The tribunal ruled that China's claim based on ancient maps is ill-founded. However, Beijing has refused to recognise the ruling and instead built artificial islands on disputed reefs.
After the supply mission in early August was blocked, China's foreign ministry asked the Philippines to remove the ship on Second Thomas Shoal, claiming Manila had "repeatedly made clear promises to tow away the warship illegally 'stranded' on the reef". It did not say who made the promise.

Given that the Philippine side did not carry illegal building materials used for large-scale reinforcement, under a humanitarian consideration, a temporary special arrangement is made for the Philippine side to transport necessary living materials including food to its "grounded" warship, Liu said.

Indonesia, as the current Asean chair, has after all underlined the importance of “maritime stability and predictability”, as Foreign Minister Retno Marsudi strongly noted at an Asean maritime forum in August. An Asean chair’s statement, for example, calling for restraint while reiterating support for Manila’s sovereign rights under the United Nations Convention on the Law of the Sea (Unclos) would be helpful, particularly if produced alongside coordinated individual statements by other South China Sea claimants, primarily Malaysia and Vietnam.

China’s “still widely underappreciated” economic downturn reduces the likelihood that it will overtake the US in the next 20 years and gives Washington an opportunity to gain influence over countries that have become indebted to Beijing, an influential US government advisory panel was told on Monday.

We have downgraded China’s GDP growth forecasts to 4.8% for 2023 and 4.2% for 2024, largely due to a weaker property sector with little additional offset, and as we foresee softer external demand. We also see lower inflation in 2024, and revise our USDCNY forecast to 7.15 for end 2023 and 7.0 for end 2024...
We believe growth is still the top priority for the government (while not the only priority, perhaps the overwhelmingly dominant one). However, the complex economic challenges and limited policy options may require careful deliberation among key stakeholders in the government and fine balancing of different tools. How to provide the right support to stabilize the property market where demand/supply fundamentals have changed and excess construction and debt have accumulated? How to deliver sufficient funding to local governments when they are struggling to service their debt, are known to have inefficient spending, and are already spending 90% of the country’s fiscal resources? In addition, the government also faces structural challenges, including an aging population and restrictions of access to advanced technology abroad, and is supposed to steer the economy away from the property- and local government-led growth toward a more sustainable and high quality one. The internal deliberation may take time and result in delays in delivering effective policy responses.

One potential consequence of the visit could be a working group with China’s commerce ministry that would discuss export controls as well as Chinese companies that have been added to a Commerce Department export blacklist.

The removals, set to become effective upon publication in the Federal Register on Tuesday, include a number of Chinese tech companies such as DK Laser Co. Ltd., Jialin Precision Optics (Shanghai) Co. Ltd. and Yunnan Tianhe Optoelectronic Co. Ltd., according to a BIS document.

The State Department is taking steps to impose visa restrictions under the authority of Section 212(a)(3)(C) of the Immigration and Nationality Act on People’s Republic of China (PRC) officials for their involvement in the forcible assimilation of more than one million Tibetan children in government-run boarding schools. These coercive policies seek to eliminate Tibet’s distinct linguistic, cultural, and religious traditions among younger generations of Tibetans.
We urge PRC authorities to end the coercion of Tibetan children into government-run boarding schools and to cease repressive assimilation policies, both in Tibet and throughout other parts of the PRC. We will continue to work with our allies and partners to highlight these actions and promote accountability.
The US State Department said the new restrictions would apply to current and former officials involved in education policy in Tibet but did not give further details, citing US confidentiality laws on visa records.
The United States separately imposed sanctions in December on two top-ranking Chinese officials, Wu Yingjie and Zhang Hongbo, over what Washington said were widespread human rights violations in Tibet.

In a chunky section of the IPO filing’s 330-page prospectus, the British designer of chips detailed a litany of challenges in the country: a concentration of business in the People’s Republic of China that “makes us particularly susceptible to economic and political risks affecting the PRC”; a downward spiral in Asia’s biggest economy; rising political tensions with the US and the United Kingdom; and the potential complete loss of control over its pivotal Chinese subsidiary.
Arm runs most of its China business through an independent unit, called Arm Technology Co., which is its single largest customer and accounted for about 24% of its sales in the year ended March. But Arm and its parent, Japan’s SoftBank Group Corp., don’t control that business.
Instead, SoftBank owns approximately 48% of Arm China, with the majority held by local investors, including entities affiliated with Allen Wu, Arm China’s former chief executive officer who was fired over allegations of conflicts of interest in 2020. The prolonged power struggle still leaves open the risk of leadership changes and affect regional operations.
“We depend on our commercial relationship with Arm China to access the PRC market,” the filing said. “If that commercial relationship no longer existed or deteriorates, our ability to compete in the PRC market could be materially and adversely affected.”

Although Arm’s shareholding in the China venture has been transferred to an SPV, the relevant changes to its domestic business registration update have not moved forward because both the Shenzhen government and Hopu have not approved the transfer. Its not yet been decided how this transfer should be registered, an industry insider with knowledge of the case said.

The fact that Arm China operates independently of us exposes us to significant risks. Arm China’s value to us as a customer is dependent on Arm China’s business results, which are, in turn, subject to substantial risks that are outside of our control. Arm China also may fail to comply with the laws and regulatory requirements applicable to its business, which could limit its ability to market or sell our products in the PRC. In addition, Arm China may fail to attract, train, retain and motivate highly skilled managerial and technical personnel necessary for its business. Arm China may also have difficulties accessing funding or enforcing contractual relationships. The realization of these or other risks related to Arm China’s business may have a material adverse effect on Arm China’s business, results of operations, financial condition and prospects and, by extension, our own. Since Arm China operates independently of us and we do not control Arm China, our ability to take measures to address the various risks facing Arm China is limited. If any of such risks related to Arm China’s business are realized, our revenue could materially decline and our results of operations could be materially adversely affected.
Under the IPLA with Arm China, Arm China’s payments due to us are determined based on the financial information that Arm China provides to us. Accordingly, similar to our other royalty customers, we are dependent on Arm China providing us with reliable and timely information. We perform various procedures to assess the reasonableness of Arm China’s data, and the IPLA includes rights for us to audit Arm China’s activities to ensure compliance with the IPLA. In the past, we have had issues obtaining timely and accurate information from Arm China. We believe the underlying problems causing our past inability to obtain such information have been resolved, but we can provide no assurances that our access to Arm China’s records will not be inhibited again in the future. If Arm China does not provide us with timely and accurate information, our revenue could materially decline and our results of operations could be materially adversely affected. We are also dependent on Arm China paying us the amounts that it owes us in a timely manner and in full. In the past, we have received late payments from Arm China and have had to expend company resources to obtain payments from Arm China. Although these historical issues did not have a material impact on our operations, any future failure to pay us the amounts we are owed under the IPLA could have a material adverse effect on our business, results of operations, cash flows and financial condition.
Furthermore, Arm China has possession of or access to certain material IP and customer data pursuant to the IPLA and other commercial arrangements with us. Although Arm China is contractually obligated to protect this IP and data, we are limited in our ability to monitor or influence the manner in which Arm China protects our IP and data from theft, loss or misuse. Arm China operates its own separate information technology infrastructure. Aside from customary audit rights and protections under the IPLA, we are therefore unable to independently assure the adequacy of protections that Arm China implements with respect to its possession and/or access to our IP and data.
In addition, under the IPLA with Arm China, we are contractually obligated to indemnify both Arm China and its PRC customers that sublicense our IP in the event that either Arm China or such customers incur damages or costs in lawsuits, administrative proceedings or similar actions based upon a claim that our IP infringes the IP of a third party. The liability that we incur to Arm China or its PRC customers under such provisions could be significant and have a material adverse effect on our results of operations and liquidity.
Additionally, since April 2022, Allen Wu, the former chief executive officer of Arm China, and certain entities under his effective control, have initiated several lawsuits in the courts of the PRC seeking to challenge certain aspects of Arm China’s corporate governance and the actions of Arm China’s board of directors. To date, all cases that have been resolved at the trial court level have been resolved favorably to Arm China but are subject to appeal. In the event that certain of these cases were to be decided adversely to Arm China, it could result in further changes to Arm China’s corporate governance and management structure, which could reduce SoftBank Group’s ability to conduct effective oversight of Arm China and result in a material adverse effect on our business, results of operations, financial condition and prospects.

They noted the success of China’s people-centered governance in Xinjiang, including the effective counter-terrorism and de-radicalization policy, which has brought peace and happiness to people of all ethnic backgrounds in Xinjiang. They also pointed out the huge gap between what they saw on this trip and how certain countries depicted the region and that the narratives and accusations attacking Xinjiang’s human rights conditions couldn’t be further from the truth.

Chinese Children Trapped in Myanmar Scam Centers: Report - SixthTone On Tuesday, a news clip from a news station in eastern Fujian province jumped to the top of social media discussions. In the clip, it was reported that at least 11 Chinese minors have apparently been tricked into joining scam companies in Myanmar since March. In the clip, which has been reposted widely, including by the official account of the Ministry of Public Security on microblogging platform Weibo, worried parents say they have found it difficult to communicate with their children, with screenshots of messages suggesting that their children are under tight control.
